Neo Jazz Radio, LLC - Advertising & Sponsorship Terms and Conditions

1. Agreement
These Terms & Conditions govern all advertising, sponsorship, promotional, and marketing services provided by Neo Jazz Radio (“Company”). Submission of payment constitutes agreement to these terms.
2. Payment TermsAll advertising and sponsorship fees must be paid in full prior to campaign launch unless otherwise agreed in writing.Reserved placements are not confirmed until payment is received.Late payments may result in delayed scheduling.
3. Refund/Cancelation PolicyDue to reserved airtime, digital placement commitments, and production preparation, all payments are non-refundable once a campaign is scheduled.

4. Creative & Production
Advertisers are responsible for providing approved creative materials by agreed deadlines. Production services (voiceover, editing, scripting, financial, etc.) begin upon confirmation and are non-refundable once initiated. Neo Jazz Radio reserves the right to refuse content that is inappropriate, misleading, or inconsistent with brand standards.
5. Ad Revisions
Client is entitled to up to one (1) revisions to their advertisement. Any revisions beyond the initial one (1) shall incur a fee of $500 per change. All revision requests must be submitted in writing, and additional changes will not be implemented until applicable fees are paid in full.
6. Content Responsibility
Advertisers assume full responsibility for the accuracy, legality, and claims made in their advertisements. Neo Jazz Radio is not liable for claims arising from advertiser content.
7. Performance & Results
While Neo Jazz Radio delivers agreed-upon placements and promotion, specific business results (sales, leads, downloads, etc.) are not guaranteed.
8. Limitation of Liability
To the fullest extent permitted by law, Neo Jazz Radio’s total liability arising out of or related to this Agreement or any advertising campaign shall not exceed the total amount actually paid by the Client for the specific advertising campaign giving rise to the claim.
9. Force Majeure
Neo Jazz Radio shall not be liable for any delay, interruption, or failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, war, civil unrest, fire, flood, labor disputes, equipment or material shortages, governmental actions, power or internet outages, or severe weather (“Force Majeure Event”).
Such events shall not constitute a breach of this Agreement, and any performance deadlines shall be extended for the duration of the delay. Neo Jazz Radio will use reasonable efforts to resume services promptly and, where practicable, reschedule affected advertising placements.
10. Governing Law
This Agreement, effective as of the date submitted, shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and the parties hereby consent to the personal jurisdiction and venue of such courts.
Acknowledgement & Agreement to TermsBy submitting payment, the Advertiser expressly acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions. Such payment shall constitute full acceptance of this Agreement and shall be legally binding as of the date of payment.
